Terms and Cancellation Policy

2. Scope of These Terms

These Terms and Cancellation Policy govern registration for and participation in educational courses, lectures, hands-on workshops and other events organised by Layered s.r.o. through the website layered.cz.

The specific content, date, venue, price and capacity of each event are stated on the relevant registration page. Where special terms are stated for a particular event, those special terms take precedence over these general terms.

The customer is the person who completes the registration and enters into the contract with the organiser. The participant is the person who actually attends the event. The customer and the participant may be different persons.

3. Registration and Conclusion of the Contract

Registration is completed through the form available on layered.cz. Before submitting the order, the customer has the opportunity to review and correct the information entered.

The contract is concluded when the organiser confirms receipt of the order to the customer’s e-mail address. For card payments, confirmation is generally sent after successful payment. For payments by bank transfer, the contract may be concluded only once the payment has been credited to the organiser’s account, unless otherwise stated in the order confirmation.

The order confirmation, these Terms and information about the purchased event will be sent to the customer by e-mail.

4. Price and Payment Terms

The price is stated on the page of the relevant event in the applicable currency. The stated price is final and includes all taxes and charges that the organiser is required to apply.

The organiser does not store or have access to payment card details.

For bank transfers, invoices are normally due within five calendar days unless a different due date is stated on the invoice. Payment is considered completed on the date the full amount is credited to the organiser’s account.

Following receipt of payment, the customer will receive the relevant accounting or tax document electronically.

5. Reservation of a Place

A place at the event is firmly reserved only after the full price has been paid.

For bank transfers, the organiser provisionally reserves the place until the due date stated on the invoice. If payment is not credited within the specified period, the registration may be cancelled without further notice and the place may be offered to another applicant.

Once the event reaches full capacity, applicants may be added to a waiting list. Being added to the waiting list does not create an entitlement to attend the event.

6. Cancellation by the Customer

Cancellation must be submitted in writing to eva@layered.cz. The date on which the cancellation notice is received by the organiser is decisive.

Unless otherwise stated for a particular event, the following cancellation conditions apply:

Failure to attend or use the registration does not create an entitlement to a full or partial refund.

Refunds will normally be made using the original payment method and no later than 14 days after the cancellation has been confirmed.

These cancellation conditions do not affect any statutory right of a consumer to withdraw from the contract.

7. Transfer of Registration to Another Participant

The customer may transfer the registration to another person free of charge, provided that the change is notified no later than five working days before the start of the event.

The notification must include the name, e-mail address, telephone number and, where relevant, the billing details of the replacement participant. A later change is possible only with the organiser’s prior approval.

A discounted student ticket or another specially priced ticket may be transferred only to a person who meets the conditions of the relevant discount.

8. Changes, Rescheduling or Cancellation of the Event

The organiser reserves the right to make reasonable changes to the programme, timetable, venue or organisational arrangements, provided that such changes do not materially alter the nature or professional content of the event.

If there is a change of the principal lecturer, a material change to the content, a change of date or another substantial modification, the customer will be informed without undue delay.

Where an event is moved to another date, the registration will automatically be transferred to the new date. If the new date is not suitable for the customer, the customer may request a full refund within 14 days of receiving notice of the change.

If the organiser cancels the event without offering a replacement date, 100% of the price paid will be refunded.

The organiser does not reimburse travel, accommodation or any other related expenses incurred by the participant, unless such reimbursement is required by mandatory applicable law.

The organiser is not liable for changes or cancellation caused by circumstances that could not reasonably have been foreseen or controlled, including illness of a lecturer, official restrictions, natural events, transport disruption or another event of force majeure. In such cases, the organiser will first attempt to arrange an alternative date or another reasonable solution.

9. Consumer’s Right of Withdrawal

A consumer is a natural person who enters into the contract outside the scope of their business or professional activity. A customer entering into the contract in connection with their business or professional activity does not have the statutory consumer right of withdrawal.

A consumer may withdraw from a contract concluded online without giving a reason within 14 days of the date on which the contract was concluded.

The withdrawal notice may be sent by e-mail to eva@layered.cz or submitted using the model withdrawal form provided at the end of these Terms.

Where the event is due to take place before the end of the 14-day withdrawal period, the consumer may be asked during the registration process to expressly consent to the service beginning before the expiry of that period.

Where the service has begun at the consumer’s express request before the expiry of the withdrawal period, the organiser may require payment of a proportionate part of the price corresponding to the service already provided. Once the service has been fully provided, the right of withdrawal expires if the consumer expressly consented to the early performance and acknowledged that the right of withdrawal would be lost.

Where the withdrawal is valid, all payments received will be refunded no later than 14 days after receipt of the withdrawal notice.

10. Complaints

Where the service has not been provided in the agreed scope or quality, the customer may submit a complaint to eva@layered.cz.

The complaint should include:

Where the customer is a consumer, the complaint will be handled without undue delay and no later than 30 days after it is submitted, unless the customer and the organiser agree on a longer period.

11. Educational Materials and Recordings

Educational materials, presentations, photographs, videos, clinical protocols and other content provided as part of an event are protected by copyright.

The participant may use them for personal and professional purposes but may not, without the prior written consent of the organiser or the author, distribute, publish, sell or reproduce them for third parties, or use them to organise their own educational activities.

Audio, video or photographic recording of lectures or practical teaching is not permitted without the prior consent of the organiser and the lecturer.

12. Alternative Dispute Resolution for Consumers

Where a dispute between the organiser and a consumer cannot be resolved directly, the consumer may refer the matter to the competent alternative dispute resolution body:

13. Final Provisions

The contractual relationship between the organiser and the customer is governed by the laws of the Czech Republic. This does not affect any rights granted to a consumer under the mandatory laws of the country in which the consumer has their habitual residence.

The version of these Terms effective at the time the order is submitted applies to the relevant order.

If any provision of these Terms is found to be invalid or unenforceable, the validity and enforceability of the remaining provisions will not be affected.

In the event of any discrepancy between the Czech version and a translated version of these Terms, the Czech version shall prevail.
